What council rules do I need to comply with?
Some things to consider
We consult to many property owners. Some of the themes we see coming through in terms of local government compliance for a carport or garage are:
1. Exempt or complying development – You may be able to build a carport or garage without having to lodge a DA with council. But the provisions which control whether or not a DA is required are quite complex, and you may find that you need assistance in interpretation of the provisions controlling exempt and complying development.
2. Building materials and colours – You have looked on the website and found that you can arrange for installation of a pre fabricated carport which is much cheaper than having one constructed. These carports are made from metal such as colourbond. But your site is located in a Heritage Conservation Area, and council has strict rules regarding the types of materials that can be used for new development within a Heritage Conservation Area. How will you meet the council requirements, when council wants only a timber carport to match the existing dwelling?
3. Location – The only area where you could place your garage happens to be located over a council drain, and the survey and stormwater report you provided to council with your DA for the new garage did not pick this up. Council wants to refuse your DA. How do you address these issues and get the DA back on track to enable a positive determination from council?
4. Unauthorised building work – You recently purchased your new home and receive a letter from council advising you that the garage attached to the house has been constructed without consent, and that unless the garage is demolished, a penalty will need to be imposed. What do you do? You don’t want to pull down the garage because it is a valuable part of the site, but you also don’t what to be fined by council? Is there any way that you can avoid a penalty but also be allowed to retain the garage? These are just some of the messy legal issues that can occur with works that are unauthorised.
