What Rules Do I Need to Comply With?
Having worked on many Carport projects over the past 25 years common compliance rules and questions to consider are:
1.
Exempt or complying development – You may be able to build a Carport without having to lodge a DA with council. For an answer to this question, please contact your council. For those projects that need a DA we specialise in the applications that have significant site restraints.
2.
Building materials and colours – If your site is located in a Heritage Conservation Area, and council has strict rules regarding the types of materials that can be used for new development within a Heritage Conservation Area. Similar restrictions may apply where there are character provisions to meet.
3.
Location – The only area where you could place your Carport happens to be located over a council drain, and the survey and stormwater report you provided to council with your DA for the new garage did not pick this up. Council wants to refuse your DA. How do you address these issues and get the DA back on track to enable a positive determination from council?
4.
Unauthorised building work – You recently purchased your new home and receive a letter from council advising you that the Carport attached to the house has been constructed without consent, and that unless the Carport is demolished, a penalty will need to be imposed. What do you do? You don’t want to pull down the Carport because it is a valuable part of the site, but you also don’t what to be fined by council? Is there any way that you can avoid a penalty but also be allowed to retain the garage? These are just some of the messy legal issues that can occur with works that are unauthorised.
