So what you need to know about Complying Development for dual occupancy in New South Wales? My name is Colin Fragar from Council Approval Group.
So when the legislation first came out for New South Wales that dual occupancies could be done under complying development, there was a lot of excitement in the industry. However, the legislation was drafted, it had very limited application. And we usually don’t recommend it for our clients.

Dual Occupancy Complying Development NSW or DA
There are still restrictions such as both dual occupancies need to have a street frontage. Even if you can get it across the line, you still have to deal with a certifier. The complying development process almost takes as long as a development application and usually, the outcome is not as good. A development application usually has more freedom. It does depend though on what you’re trying to achieve and what the site itself allows.Take the Next Step
