What are the laws in New South Wales about dual occupancies?
Hi, my name is Colin Fragar. I’m the CEO of Council Approval Group.
For over 25 years, we’ve now been helping thousands of people, particularly in New South Wales, understand the laws related to dual occupancy. And what I recommend is that you grab a copy of Your Ultimate Guide in Achieving Council Approval. We put this together for people like you. It goes through a whole bunch of tips and tricks on different development types, whether it’s dual occupancy or others, but we actually specifically have in here some special pages about dual occupancies to help you to understand those laws.
Dual Occupancy Laws in NSW
If you have a project in mind, you need to know there are so many multiple layers of legislation, particularly in New South Wales related to dual occupancy. You can have state based legislation which allow for a fast track process, although we don’t usually recommend that. Or you can have a development application through your local council with the LEP. With a development application you’ve also got to understand not only the LEP, meaning Local Environmental Plan, but also the Development Control Plan or DCPs.But really it gets down to your site specific zoning and what you’re trying to achieve. So really, that’s probably a dialogue between us, one of our team, and yourself.
