How do you apply for a Dual Occupancy approval? My name is Colin Fragar from the Council Approval Group.

This is a question that we often get and we’ve literally helped hundreds, if not thousands, of clients to get an approval for dual occupancy. It’s not as easy as you might think. There are a lot of hoops that you need to jump through, and a lot of loopholes that we jump through to be able to pull it off.

We hire ex-Council staff to be able to do this, team members that used to work within local government that know how council officers think. They know the paperwork. They know how to pull together documentation and then, importantly, carefully navigate it through the council assessment process.

So how do you apply for dual occupancy? The very first step that I would recommend is that you book in for a consultation with one of our team about your property and what you want to achieve.

Have a Plan for Achieving Approval

The second step that they’re likely to recommend is a Preliminary Planning Assessment. Now this is specifically designed for you. It’s designed so that we can look at all the different rules and work out what your chances of success are. Is there a departure that we can pull off that we feel comfortable based on our 50 years of experience? We determine whether or not we can get it through Council, even though there might be a few things that we may not meet, and then give you a clear path and road map for going forward. So that would be your second step.

Apply for your Dual Occupancy

After that, then we would apply to Council for your dual occupancy. We usually do not go down the certifier route. They call it CDC or using their code assessment, we usually don’t go down that path, because we usually find that we can achieve a better result in just as much time with a development application. So there’s some tips, hopefully that helps.
I would really encourage everybody to keep going with your dual occupancy application. Don’t get flustered by the challenges that exist in property development in Australia. This is a legitimate property investment strategy.
