So what you need to know about a dual occupancy CDC? My name is Colin Fragar from Council Approval Group.
When dual occupancies were first proposed to be a complying development certificate, there was a lot of excitement at the time in the industry. It was thought that all of a sudden the process for approval would be much easier for dual occupancy. However, particularly in the state of New South Wales, a dual occupancy CDC has very limited application.

Limitations of a Dual Occupancy CDC
For example, the reading of the statute says that both dwellings in a dual occupancy need to have a street frontage. Now there’s not many dual occupancies that we can do that for unless they are on corner lots. And, usually, there’s something that we can do better than a dual occupancy CDC for a corner lot.Also, if you aren’t able to make it work, or even if you are able to pull it off, we usually find that working through a certifier for complying development is just as much work. It takes almost just as long and usually you don’t get as good of an outcome. We usually recommend to our clients that they go down the development application path.
